Eminem's Manhattan Federal Court battle with The Source magazine came closer to an end yesterday after his lawyers withdrew the case, and his controversial early recordings could again become public.
"There is nothing left to win," the rapper's attorney, Donald David, told us. "The judge already decided we have the copyright, and he awarded us $131,000 in sanctions. So the case has no purpose anymore."
The rapper sued the mag for copyright infringement after the hip-hop bible printed racially charged lyrics in which a then-teen Eminem called black girls "dumb."
Claiming victory, Source owner Dave Mays told us, "They want this withdrawal so they can avoid the public embarrassment of having Eminem on trial in New York."
Mays argues that the fate of the recordings will be decided Monday, when Judge Gerard Lynch is due to rule whether the case has been withdrawn "with prejudice" (meaning that it can't be refiled). May contends his mag will then be free to publish Eminem's lyrics.
Adds Mays, "We have been vindicated whichever way it goes."
