THE judge in Michael Jackson's child sex trial has instructed jurors not to be swayed by "pity," or "prejudice" or "public sympathy" when considering the superstar's fate.
Judge Rodney Melville told the panel of eight women and four men that "pity" and other emotional and external considerations should not colour their decision on whether or not to find Jackson guilty.
"You must not be influenced by sentiment, conjecture, prejudice, public sympathy or public feeling," the judge said after summoning jurors back into court after a day and a half of legal wrangling out of their earshot.
Some instructions to the jury:
- "A defendant in a criminal action is presumed to be innocent until contrary is proved, and in case of a reasonable doubt whether his guilt is satisfactorily shown, he is entitled to a verdict of not guilty."
- "You must not be influenced by sentiment, conjecture, sympathy, passion, prejudice, public opinion or public feeling. Both the People and a defendant have a right to expect that you will conscientiously consider and weigh the evidence, apply the law and reach a just verdict regardless of the consequences."
- "You must not draw any inference from the fact that a defendant does not testify." Jackson did not speak out in his own defence during the trial.
- "... certain identified passages from the video Living with Michael Jackson have been offered for their truth as 'admissions' ... You are the exclusive judges as to whether the defendant made an admission, and if so, whether that statement is true in whole or in part." Jackson acknowledged in the 2003 television documentary he liked having children in his bed.
- "Evidence has been introduced for the purpose of showing that the defendant engaged in sexual offences on one or more occasions other than that charged in the case ... If you find that the defendant committed a prior sexual offense, you may, but are not required to, infer that the defendant had a disposition to commit sexual offences. If you find that the defendant had this disposition, you may, but are not required to, infer that he was likely to and did commit the crime or crimes of which he is accused."
"However ... this is not sufficient by itself to prove beyond a reasonable doubt that he committed the charged crime."
"Evidence that at some other time a witness made statements that are inconsistent or consistent with his or her testimony in this trial, may be considered by you not only for the purpose of testing the credibility of the witness, but also as evidence of the truth of the facts as stated by the witness on that former occasion."
- "You are the sole judges of the believability of a witness and the weight to be given the testimony of each witness."

I haven't heard all of the evidence so I'm still not sure if I think he is guilty or not. But I still don't trust that Al<something>ro woman & her kid

I don't think he is guilty, but I want to see him be found guilty, because it's always funny when a celebrity goes to jail.

I think he's just weird enough to not be guilty. He's obviously a bit strange if he can sleep with some kid and not see anything objectionable about it.

I've slept with kids lots of times, boys and girls, and I don't see anything objectionable about it...hell, my 22 yr old nephew still comes and climbs in bed with me to watch cartoons on a sunday morning, if he's visiting..

Elegant... that's not exactly on the same level as a middle aged man sharing a bed with little kids he has no relation to. That strikes me as a lot creepier.

I have been watching the trial carefull and I have come upon a decision.
There is no doubt in my mind that Michael Jackson is a pedophile, that he has very severe psychological and emotional problems and is not developed properly in either area's.
HOWEVER, the child's mother is a greedy money hungry whore and half of the charges are bullshit. They deserve NOTHING.
Doesn't matter because Jackson is going to get off anyway...didn't you guys watch the fucking Blake case? If there was ever a mother fucker who killed his wife and got away with it it was Robert Blake.. ... grrrr (gets mad at the idiotic world again) :x
