gestern ist bei vielen von euch sicher auch diese Email von CMS eingegangen. Ich will hier kurz schreiben, was es damit auf sich hat.

CMS schreibt, das sie die gesammelten privaten Daten der Kunden und auch die Handelshistorie nie an andere Stellen weitergeben, ausser es handelt sich um eine offizielle Anfrage von Ermittlungsbehörden etc.

Ehemalige Kunden bekommen die jährliche Privacy Notice nicht mehr.

Man kann sich bei der NFA über die Grundeintragungen der einzelnen Broker informieren. Dazu gehe man auf folgende Seite und suche mit dem Namen des Brokers oder der Registriernummer.

As a registered Futures Commision Merchant (“FCM”), Capital Market Services, LLC (“CMS”) is required by the rules and regulations of the Commodity Futures Trading Commission (“CFTC”) and National Futures Association (“NFA”) to provide our customers with an annual statement of our privacy policy. Along with CMS’ privacy notice, we also enclose an annual notice about NFA’s Background Affiliation Status Information Center (“BASIC”).

Categories of Personal Information Collected
When you become a customer of CMS, certain personal, private information will be collected. This includes the information you provide on your account application, such as name, address, tax identification numbers, bank information, prior trading experience, etc.

We also collect copies of government issued identification materials such as passports and drivers licenses in order to verify the identity of its customers for our Anti-Money Laundering procedures.

Finally, your usage of our services generates trading and transaction histories to which we have access.

CMS will not disclose or share any of the above information with any other party, except as required or permitted by law to fulfill our regulatory responsibilities.

CMS’s policy for protecting the security and confidentiality of information
Only those personnel for whom the information is necessary to complete a given transaction shall possess the authority to access the information. CMS, its personnel, and its affiliates shall strictly adhere to security practices and procedures to ensure the confidentiality of your information.

Former Customers
CMS will continue to protect the privacy of former customers’ personal information in the same manner as when they were customers. Unlike continuing customers, however, former customers will not receive annual privacy notices.

NFA BASIC Annual Notice

NFA’s Background Affiliation Status Information Center (BASIC) contains Commodity Futures Trading Commission (CFTC) registration and NFA membership information and futures-related regulatory and non-regulatory actions contributed by NFA, the CFTC and the U.S. futures exchanges.
