    SPRINGFIELD - The owner of a Sunderland fish hatchery was ordered to serve six months in a federal halfway house and pay a $65,000 fine for killing protected birds on his property.

    Michael J. Zak, Jr. 59, owner of the Mohawk Fish Hatchery, was also ordered to serve five years probation and have no contact with firearms by U.S. District Judge Michael A. Ponsor.

    A co-defendant in the bird-killing case, Timothy Lloyd of Easthampton, was given two years probation and a $1,500 fine by Ponsor during the sentencing in U.S. District Court.

    Zak was found guilty in April of violating the Golden and Bald Eagle Protection Act for shooting an eagle that was feeding at his uncovered fish hatchery in 2005.

    Zak and Lloyd separately pleaded guilty to shooting great blue herons and other federally protected birds on his property. They were arrested by federal agents following a raid at the hatchery that uncovered evidence of widespread bird killings.

    Ponsor said evidence in the case suggested that hundreds of birds were gunned down at the hatchery owned by Zak off Route 116 in Sunderland between 2004 and 2006.

    He said he was baffled why Zak, whom he described as a wealthy and accomplished hunter, never bothered to install netting over the fish runs, a tactic used by other hatcheries.
