    First, I apologise for posting to this forum in English. The very small amount of German I learnt at school has almost entirely been forgotten.

    There seem to have been a lot of anti-Hauptwerk feelings and accusations directed at me and Hauptwerk recently on the German forums, which I think it is fair to attempt a reply to.

    I want to stress that it most definitely is *not*, and never will, be a requirement for any sample set to use the new dongle-based sample set licensing mechanism. It exists only because some sample set producers require it, and, as I always have, I fully support *all* sample set producers in whatever they do, and however they wish to licence their sample sets. It is for the users to decide what sample sets they wish to use, not me. The larger the choice of sample sets, the better for the user.

    In my view, the sample set licensing mechanism is no different to a sample set licence agreement (unless a user actually intends to break the licence agreement), so there is absolutely no difference from either an honest user's perspective or a sample set producer's for a sample set that has such an agreement. The sample set licence is decided by the sample set producer (not me) and defines what the user is and isn't allowed to do with the sample set, just as it always has been. The user then makes his decision to buy the sample set or not based on whether it meets his or her needs and whether he or she agrees with the licence for that sample set.

    I hope you understand my position on this - it is absolutely not my intention to restrict anybody's liberties, invade anybody's privacy, etc. - I am just providing an option which some sample set producers require otherwise they will not release sample sets in Hauptwerk format. In particular, there are various major new sample sets coming from new third-parties that will not exist if the licensing mechanism was not implemented. I think it would be a loss to all of us if the option to have those sample sets did not exist. It would also not be fair on those users that are happy to use such sample sets, which, in my experience, is the majority.

    In summary: it is only an option!

    I also have nothing per-se against anybody selling his or her copy of Hauptwerk and/or any sample sets licensed on the dongle to anybody else, provided that the sample set producer's licence for the sample sets allow it and provided that the new user accepts the terms of whatever licence agreements are involved.

    For example, Hauptwerk's wind supply model cannot presently be sold in the U.S. for legal reasons, so I need to have a licence restriction that users are not allowed to transfer licences between countries without permission. Likewise, the MySQL interface requires licence certificates from MySQL AB, so I have to abide by MySQL's licence agreements regarding transfer of licences.

    If there is a wish for people to transfer licences for Hauptwerk and/or sample sets, I will be happy to revise the licence agreement for Hauptwerk to allow it, subject to these conditions being satisfied (i.e. the licence agreements being accepted by the buyer). If any remote update of the dongles is necessary (e.g. transferring just one protected sample set) then I would need to make a small charge to cover the administration work (probably something like 10 GBP), since I will be hiring additional help to handle it.

    So I think you may actually find you have more freedom as a result of the system, since most sample set licences did not previously allow transfer of sample sets because of risk of piracy. Likewise with Hauptwerk itself.

    I honestly think it is a very fair system for everybody involved and it isn't meant to impose any additional restrictions or reduce choice of sample sets in any way. In fact, quite the reverse.

    I'd also like to point out that myself and most (if not all) of the sample set producers are very small companies or private individuals who work extremely hard at what we do, and make a very small income from it. We do it because we enjoy it and believe in it. I don't think it is fair to compare us with multi-national, profit-driven companies. Speaking for myself, I am simply trying to make a living in a very small niche market indeed, and I think that Hauptwerk's prices are very fair for the enormous amount of work and money that I put into it, and the small number of copies it sells. I certainly hope that nobody feels cheated by what they get. I definitely don't want to rip anybody off or out-price anybody; I just have to be able to pay my rent!

    The majority of the features in version 2.10 (e.g. usability/performance improvements) were originally planned for version 2.00 but had to be postponed due to the need on my part to have income from sales, and also to get the version 2 sample set format established. It's a free upgrade from v2 so I think that's fair enough.

    Finally, and at the risk of stirring up a hornets' nest, concerning MyOrgan, I would just like to say that personally I view it is 95 percent direct plagiarism of Hauptwerk and my work. Anybody is of course entirely free to disagree with me on that, and I'm sure some of you will, but I hope you understand my position and the reason that I am not happy to support it.

    I would view it as fair competition if it had its own sample set format, used and developed its own sample sets, working independently with sample set producers, and did not have a feature list which bears a truly remarkable resemblence to Hauptwerk version 1 plus a few features from version 2 (granted, memory compression was implemented by MyOrgan first, but that has been declared as targeted for Hauptwerk version 2 since long before MyOrgan appeared, but was postponed until v2.10).

    In my view, a declared desire to make virtual organs and sample sets available as cheaply and freely as possible, however well-meant that may be, doesn't justify what I would see as wholesale theft of years of other people's work and intellectual property, and is not fair on those of us whose livelihoods depend upon it.

    As Kirk has previously pointed out to me, mass copying of each others' features and file formats is perfectly common behaviour between some software giants, and they usually manage to get away with it, but I'm not sure that I, as the smallest of the small, necessarily deserve this, or that it is entirely commendable behaviour.

    OK, dann bestelle ich gern die Update-Option meiner HW1 auf HW2.1 OHNE Verdongelung. Auf Zugang zu verdongelten Samples kann ich verzichten.

    Für Endverbraucher wäre es wohl auch Mindest-Service, die Lizenzbedingungen vorher und die Bedienungshandbücher nachher verbindlich in deutscher Sprache zugänglich zu haben. Ein Preis der Professionalisierung und Kommerzialisierung, wenn man so will. Könnte sein, dass das Juristen andernfalls als Produktmangel werten, der Nachbesserung oder Wandlung auslöst.

    Ich bin seit dem Kauf von Ver.1 NICHT krimineller geworden und verteile auch keine illegalen Kopien in der Weltgeschichte. Unzufrieden mit dem Produkt bin ich auch nicht bisher ...


    Wenn sich also NICHTS geändert hat von beiden Seiten, WOZU dann so ein blöder Stecker, der kaputtgehen kann, verlorengehen, entwendet werden, etc ...

    Der Versuch, sich rauszumogeln mag noch nicht strafbar sein ...
    Spätestens mit HW2.1 hat er sich in die kommerzielle Liga mit strikteren Bandagen begeben. Es gibt beim Verkauf an Endverbraucher umfassenden Verbraucherschutz, da kann sich IMHO niemand um eine für (auch nicht englisch lesen könnende) Laien verständliche Lizenzbedingungen und Bedienungshandbücher drücken und auch die Lizenzbedingungen haben Standards zu erfüllen. Es könnte sich rasch zum Produktmangel mit Regressanspüchen von Käufern entwickeln.

    Der Verweis auf ein käuflich von Dritten erwerbares deutsches Anleitungsbuch ist IMHO nur noch eine grobe und respektlose Unverfrorenheit und lässt jede Sensiblität für den Markt und die Auswirkungen vermissen. Schnodderige Sprüche helfen jetzt nicht mehr ...

    Richtig. Nur ist das schwierig zu prüfen für den Endbenutzer (Selbstanzeige wäre die einzige mir bekannte Möglichkeit).

    Ich bin mir nicht sicher, ob es kostet und ich weiß auch nicht, ob M. D. selber darauf verwiesen hat -- nur damit keine Missverständnisse entstehen.

    Jetzt kommen wir zum PUNKT. Was genau ist "Spezialsoftware" IMHO ist dies nach gebräuchlicher und auch juristisch kommentiertem Sprachgebrauch Software, die speziell für EINEN Kunden entwickelt wurde.
    Demgegenüber Standardsortware Software, die für die Bedürfnisse einer Vielzahl von Kunden entwickelt wurde Wohlgemerkt, NICHT die faktische Verbreitung ist her Unterscheidungskriterium, sondern das Entwicklungsziel ... für eine Mehrzahl von Kunden ...

    Ich kann mir kaum vorstellen, dass dies Mauseloch zieht ...

    Jetzt kommen wir zum PUNKT. Was genau ist "Spezialsoftware" IMHO ist dies nach gebräuchlicher und auch juristisch kommentiertem Sprachgebrauch Software, die speziell für EINEN Kunden entwickelt wurde.

    Sorry, dann habe ich das falsche Wort gebraucht. Ich meinte das Gegenteil von Allerweltssoftware wie Netscape, MS Office, Adobe Photoshop o.ä.

    Viele werden doch (wie ich) beruflich oder privat Software nutzen, die einen kleineren Benutzerkreis (kleiner, aber größer 1 Kunde) als oben genannte SW anspricht (CAD/CAM/CAE, Businesslösungen, SW für Maschinen/Laborgeräte,...). Dort ist es wie gesagt eher selten, dass alles deutsch ist... Und eher selten, dass die SW günstig ist... Und eher selten, dass wegen der englischen Anleitung gewandelt/gemindert wird...

    Mehr kann ich dazu nicht sagen.
